ABSTRACT
Em direito, diz-se que a perícia é um dos meios probatórios de prova. Com a aprovação do novo Código de Processo Civil pela Lei 13.105/15, aconteceram modificações importantes envolvendo a obtenção da prova pericial, tais como: a previsão completa de um procedimento pericial a ser seguido pelo juiz (e pelo perito), a disciplina do laudo pericial, a regulamentação da prova técnica simplificada", a criação "perícia consensual" e a criação do cadastro de potenciais peritos junto aos tribunais. As alterações tiveram por objetivo organizar melhor a atividade pericial, assegurar a qualidade e a capacidade do técnico que atuará na instrução processual e, principalmente, estabelecer um ritual a ser seguido pelo magistrado durante a realização da prova pericial.
From a legal scope, the technical expertises are considered as scientific pathways to produce forensic evidences. After the approval of the new Brazilian Code of Civil Procedure (Federal Law 13.105/15), important alterations involving the production of forensic evidences were observed, such as the inclusionof a complete legal procedure to be followed by the judge (and the forensic experts), the standards forforensic reports, the regulation of the "simplified forensic evidence", the creation of consensual forensic examinations, and the creation of a database containing potential forensic experts in the Court. These alterations were developed to organize the forensic activities, assuring higher quality in the technicalperformances of the forensic experts named legally for each case. Moreover, these alterations established a systematic sequence of events to be followed by the legal authorities during the production and acquisition of forensic evidences.
